Having the proper will and estate plan is important. If you die without a will, the following events may occcur:

  1. Your net estate will be distributed in accordance with a predetermined statutory formula, not in accordance with your wishes
  2. The administrator for your estate will be determined by the Courts
  3. Your heirs could receive a smaller distribution from your estate because of increased federal estate and Pennsylvania inheritance taxes

For those in the higher tax brackets, a will containing tax-driven trusts can minimize federal estate taxes in your and/or your spouse's estate. A family limited partnership can be utilized to transfer assets to children while allowing you to retain substantial control over those assets.

A properly drafted power of attorney or living will can ensure that your wishes will be carried out, even if you are incapacitated or in a terminal condition.
